The Food and Drug Administration (FDA or USFDA) is an agency of the United States Department of Health and Human Services, one of the United States federal executive departments, responsible for protecting and promoting public health through the regulation and supervision of food safety, tobacco products, dietary supplements, prescription and over-the-counter pharmaceutical drugs (medications), vaccines, biopharmaceuticals, blood transfusions, medical devices, electromagnetic radiation emitting devices (ERED), veterinary products, and cosmetics. The FDA also enforces other laws, notably Section 361 of the Public Health Service Act and associated regulations, many of which are not directly related to food or drugs. These include sanitation requirements on interstate travel and control of disease on products ranging from certain household pets to sperm donation for assisted reproduction. The FDA is led by a Commissioner of Food and Drugs, appointed by the President with the advice and consent of the Senate. The Commissioner reports to the Secretary of Health and Human Services. The 21st and current Commissioner is Dr. Margaret A. Hamburg. She has served as Commissioner since February 2009. The FDA has its headquarters at Silver Spring, Maryland and has 223 field offices and 13 laboratories located throughout the 50 states, the United States Virgin Islands, and Puerto Rico. The government agencies who require those products to be withdrawn from sale do not have the power to prevent those products from being sold overseas. Q. Since I cant find an open question for this subject, and can not answer a closed one, I will make a new question for this problem. Hopefully this resolution will help others who have had the same difficult problem of sending Habu Sake from Japan back to the states. After contacting the U.S. Fish and Wildlife Service, I received this e-mail response regarding the shipment of Habu Sake into the states: Dear Paul, Thank you for your inquiry regarding the importation of habu snake wine from Japan that will require clearance by the U.S. Fish and Wildlife Service. The "Form 3-177" IS difficult to complete. The form also seems to suggest that an "Import/Export License" is required. Not to mention that you have to get in contact with multiple persons and agencies in order to make the shipping process go smoothly. I suggest that you enjoy the Habu Sake while you're in Japan, consider it part of the Japanese experience, and leave it in Japan. Its really not worth all this effort. Or, if you don't mind risking the price of a bottle of Habu Sake--up to $300--and the shipping fee, you could just mail the thing and hope it gets cleared. It isn't illegal in the states, so you can't really get in trouble.
